Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the mobile game Magic Brick Breaker (the “Game”) published by Z-Rex (“we”, “us”, or “our”). By downloading, installing, or playing the Game, you agree to these Terms. If you do not agree, do not use the Game.
1. Eligibility
You must be legally permitted to use the Game in your jurisdiction. If you are under the age of majority where you live, you may use the Game only with the consent of a parent or legal guardian who agrees to these Terms on your behalf.
2. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and play the Game for your personal, non-commercial entertainment on devices you own or control. You do not acquire any ownership rights in the Game or its content.
You may not:
- Copy, modify, distribute, sell, or lease any part of the Game
- Reverse engineer, decompile, or attempt to extract source code except where permitted by law
- Use cheats, exploits, automation, or unauthorized third-party tools to alter gameplay
- Interfere with servers, networks, or other users’ enjoyment of the Game
- Remove or alter copyright, trademark, or other proprietary notices
3. Game Features and Virtual Items
The Game includes virtual items such as scores, diamonds, stars, power-ups, and ball counts. These items have no real-world monetary value, are not transferable outside the Game, and may be modified, balanced, or removed at our discretion as part of updates.
Progress is stored locally on your device. We are not responsible for lost progress due to device failure, uninstallation, or clearing app data. We may add cloud save or account features in future versions; such features would be subject to updated terms.
4. Advertisements
The Game may display optional rewarded video advertisements through Google AdMob when you choose to watch an ad for in-game benefits. Watching ads is voluntary. Ad content is provided by third parties; we do not control and are not responsible for third-party ad content or websites linked from ads.
Your interaction with ads is also subject to our Privacy Policy and Google’s terms and policies.
5. In-App Purchases
The Game is currently free to download and play. If we introduce in-app purchases in the future, those transactions will be processed by the applicable app store (e.g., Google Play). Refunds are handled according to the store’s refund policies. Prices and availability may change without notice.
6. Updates and Availability
We may release updates, patches, or new versions of the Game at any time. Some updates may be required to continue playing. We may modify, suspend, or discontinue the Game or any feature with or without notice, to the extent permitted by applicable law and app store rules.
7. User Conduct
You agree not to use the Game to:
- Violate any applicable law or regulation
- Infringe the rights of others
- Transmit harmful, offensive, or unlawful material through any support or community channel we provide
- Attempt to gain unauthorized access to our systems or other users’ data
8. Intellectual Property
The Game, including its code, art, audio, trademarks, and “Magic Brick Breaker” name, is owned by Z-Rex or its licensors and is protected by copyright, trademark, and other intellectual property laws. Except for the limited license in Section 2, no rights are granted to you.
9. Third-Party Services
The Game may integrate third-party services (including Google Play and Google AdMob). Your use of those services is subject to their respective terms and privacy policies. We are not responsible for third-party services.
10. Disclaimer of Warranties
THE GAME IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
Some jurisdictions do not allow certain warranty exclusions; in those cases, our disclaimers apply to the maximum extent permitted by law.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Z-REX AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE GAME, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE GAME OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE GAME IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) TEN U.S. DOLLARS (USD $10).
Some jurisdictions do not allow limitation of liability for certain damages; in those cases, the above limits apply only to the extent permitted by law.
12. Indemnification
You agree to indemnify and hold harmless Z-Rex from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your misuse of the Game or violation of these Terms, to the extent permitted by applicable law.
13. Termination
We may suspend or terminate your access to the Game if you violate these Terms or if we discontinue the Game. You may stop using the Game at any time by uninstalling it. Sections that by their nature should survive termination (including Sections 8, 10, 11, 12, and 14) will survive.
14. Governing Law and Disputes
These Terms are governed by the laws applicable in your country of residence, without regard to conflict-of-law principles, except where mandatory consumer protection laws of your country provide otherwise.
If you are a consumer in the European Union, you may also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr. We are not obligated to participate in alternative dispute resolution proceedings unless required by law.
15. Changes to These Terms
We may update these Terms from time to time. We will post the current version on this page and update the “Last updated” date. Material changes may be communicated through the Game or app store listing where appropriate. Your continued use after changes become effective constitutes acceptance of the revised Terms.
16. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Z-Rex regarding the Game and supersede prior agreements on that subject.
